I feel like crap, but my work won't let me stay or go home. This is the second time this has happened. I work at a small business, I do most of the office work and the owner does some office work, some field work, and a lot of no work. I tried to call in sick about a month ago, I said "Hi, I'm not feeling very good this morning, would it be okay if I didn't come in today?" he replied with "No...but you can come in at noon." I thought maybe he was going to be busy, but when I got to work he just played all day! Today, I came to work and finished everything I had to do. I asked him if he had anything else, he said no, so I asked if I could go home early. He said no because he and his wife are going to lunch and shopping. The office phone is a cell phone, but he didn't want to take it and be disturbed. What do you suggest I do about this? Is there anything to do? Thanks!

No, you are an "at-will" employee so you have a choice... do what your employer wishes or find another job.

I had an employer like this too. He once made us take work to another co-worker's home who had called in sick. If you have an answering machine, I would call in early before anyone comes in and leave a message saying that you are sick and cannot come in. That why you avoid the guilt trip that a lot of employers try and lay on you. If you have Caller ID or an answering machine at home, you can screen your calls in case your employer tries to call you at home. Just don't answer the phone. When your employer asks you why you did not answer your phone - just tell him or her that you were too sick. If necessary get a statement from your doctor. Employers have to honor a doctor's statement requiring you to be off work due to sickness or injury. In the meantime, LOOK FOR ANOTHER JOB!

in CA, there is no official law regarding time off except for that if a company has a policy regarding time off, it must follow that policy.

if your company does not have a policy about sick/vacation time, then you may be out of luck. if there is a published policy, then your company is obligated to follow that policy.

the ethics surrounding the actions of your boss sucks, but it sounds like there is very little you can do.

however, if you have suffered an "injury" as a direct result of your illness AND because you were forced to work, then you may be able to sue your employer for damages.

my suggestion is to move on and find another job.

I have totally been there. There is nothing that you can do without pissing off your boss. My boss tells me this all the time. Or even when I do schedule a day off he calls me and asks me to go in. It is one of the downfalls of working for a small company.

Rather than asking, tell them "I'm sick today and won't be able to come in." You left the door open by asking permission.

Depends on your corporate policy and/or your contract.

But, if you're sick, you don't say "is it ok" ... you say, "I cannot make it because I have severe stomach problems", etc.
