No because the motion is voluntary and is not clearly the intent of the photos/vids. The way most in the industry get out of it is by saying that it is art.

You wouldn't do those things to a Picaso would you?

Stupid, but technically it's art. You can't sue over art according to the gov't. So no, no way to sue. Try McDonald's. Gain weight and sue them because you get fat.

You can sue.
But they can argue that they didn't create their film for that purpose, and that you have misused and misunderstood their art.
With any kind of luck, it will end up on Court TV, and then you'll have Nancy Grace calling you, wanting to know why your neck is stiff, too...
