I am curious to know if the employee is allowed to take the unused copper pipe home or would that be considered stealing?

My Dad had an A/C biz years ago. The copper pipe is worth money, even recycled. If someone took it without permission, that would be stealing.

I have not worked in an air conditioning business, but I have worked in other businesses where that activity would have been considered stealing. Unless the employer gave explicit permission, the employee cannot take anything from the business home.

If I had a business that had unused copper pipe that could not be used, I would collect it and sell it as scrap for the business, not hand it out to the employees to sell for themselves. With more capital I can increase the business and see about getting the employees more pay and benefits. Besides, if they are taking home enough scrap to sell, I need to think about the tax implications because that can be considered income.

It depends on IF the a/c unit is replaced.IF so,it's "legal"
