Our company had an office Christmas party, which they made mandatory for all employees to attend. This included an anonymous gift exchange, where we were required to bring a small gift of roughly $10 value. Despite informing my supervisor that I'd rather not attend, I was told that I would have to, so I might as well enjoy myself.

I went down to the local adult toy store and bought one of those anal plugs. I wrapped it up and brought it to the gift exchange party. As luck would have it, my supervisor was the one that received the anal plug, and he was none to happy about it. Now he's threatening to find the person responsible and fire them.

Can he legally do this? If it turns out that I do get fired over this, can I sue since I was forced into attending a party that I would've preferred not to attend?

ha ha ha that's great you have an awesome sence of humor. I hope your boss really uses that they can't make it mandatory. I think you might have a lawsuit let them know it was you that way you get fired and can sue the **** out of them, unless they are wearing their shiny new *********. Kudos my friend!

LOLOLOL I don't know what the Law Books would say about this, but in your shoes, by golly I'd get me a good mouthpiece and make that company -whatever they are - wish they had never laid eyes on me. I think you probably acted a little unwisely with that "gift" but for crying out loud, I can't think of anything more ridiculous than a forced attendance at a Christmas Party, and at least an implied threat of consequences if you didn't. My bet is that if you let this supervisor, or his superiors, see very clearly that you are not going to take this lying down, rather than have the whole outrageous thing get aired in court - with a newspaper writeup, no doubt - they will decide to "be gracious" and drop the whole thing. Myself, I'd find it almost worth losing the job over just to get the idiots in court so the whole ludicrous idea of a mandatory christmas party attendance is aired in public.

Dude, what were you thinking? And you're not asking this on your work computer, are you? Of course you can be fired for this! Depending on the state in which you live, if you're not in a union you can be fired for f-ing anything, let alone giving a b.utt plug to the boss!

I agree that there's nothing more boring than an office party and nothing more entertaining than a b.utt plug, but sometimes you have to bite the bullet and be a good sport. And of course he knows it was you! You made a big fuss and call yourself The Naughty Scotsman - you might as well have "I bought the B.utt Plug" painted on your forehead! You'd better pray that the holidays distract him from going undercover at the local toy stores.

Don't you love it when you're commanded to have a good time? If the party was on work time, you were obligated to attend, unless you were taking personal time off. The "gift" was in very poor taste and if found out, your job could very well be at risk. I doubt your supervisor could actually prove who it came from, though. If fired, any lawsuit would depend on whether the office party was considered a "work assignment" on company time. Just an opinion from my years as a manager. Good luck w/that and use a little more tactfulness in the future, lol!

You're not likely to get fired for the party, especially since you attended.

The incredibly inappropriate gift is what might get you fired and it's doubtful that you'd have any legal recourse. Just to make sure you understand, I think it's funny and appropriate to give that sort of gift among friends, but in a company setting it probably violates several policies that you've already read and signed or acknowledged. Bad bongos.

Why would you take an anal plug as a gift? What were you thinking. Did you really care about this job? I hope not b/c somebody will tell on you to cover themselves.

No he cant get you fired,But don.t let on who got the Bum plug,Cos he will make your life hell.PS no Christmas party is mandatory,Unless it took place during your working hours,I think that your gift went to the right person! That's great! The problem with management is that they already have anal plugs in place.

In any case, you can get fired if you are in an employment-at-will state for any reason.

Can he find out it was you? Yes but only if you have talked to only one other person at your office about it. Have you?

Don't own up to it, and I seriously hope you haven't told anyone that you work with about it.. lmao. You could try suing for wrongful termination, but they would have you by the short hairs for sexual harrassment. If you get fired, it would be best just to find another job. Good luck!

I think it is time to go on the offensive about being so offensive.

Take your boss aside, tell him it was you and that you deeply regret the incident. Be a stand up guy about it.

Tell him that you understand now that it was terribly inappropriate and that you thought it would be a funny gag and hadn't really thought it through on a sexual harassment or company sensitivity level.

While it is too late to show your maturity at the company party... it isn't too late to do so now.
