I work in an office that has a flexi time policy. The office policy is to be at your desk by around 8.30am. We do not work in a service industry and therefore have no direct contact to customers. The hitch is I am employed by an angency and placed inside this company. The agency is now threatening to fine me money from my wages because I have not adhered to the agencies time keeping policy of being in the office by 8am. I arrived between the hours of the company where I am placed. Is the agency allowed to fine me money?

Read your contract. If they want to fine you, it has to be in the contract. If the contract states that you must adhere to the company policies, then you should be covered. However, if your contract says you must arrive for work at 8am and work until x time, then that is what you should be doing. However, do you have a time clock you punch? If not, how do they know your arriving late. Get a free consultation from a lawyer who specializes in contracts. You may have to bite the bullet, but if not, then threaten them right back. Start looking for other work now though, then you may be able to just tell them to go fu*k their hat. Good luck.

The company where you are working has specified to the contracting company (agency) for your sevices. At the company there is someone who must 'sign off' on your time card and validate that you were there and they would paid the agreed upon rate. This person would be the person at the company that you report to and/or have sign your time card. I suggest that you go talk with this person and ask them to explain the time requirements you are expected to work under. If they say it's flex time then your OK, if not.. well... your screwed.

Let's go for the better of the two outcomes where they say flex time is OK. You should then explain that was your understanding as well, however, your supervisor at the 'Agency' must be confused as to the hours expected. Ask the company supervisor to explain the hours expected and your current job performance by either a)contacting the agency supervisor or b)creating a memo/letter that you can deliver.

Remember two things. 1) The agency is making money off of you and as long as the customer (Company supervisor) is happy every thing should be great. 2) If the customer wants a specific time of work then that's what you should be working in order to satisfy rule number 1.

But the biggest piece of advice I can give you is to deal with this in an unemotional, rational business attitude. If you get angry or upset then you will most likely not get what you want (flextime).

I used to work for a agency for 5 years and worked as a temps consultant so placed people like you into work! As far as I know there is no way that an agency can fine you money - and they're bad in my opinion to even threaten you with it. The only thing they can really do is pay you for the actual hours you work - i.e. if you are late they pay you the reduced hours because you were not there at 8am or whatever which is fair enough. Check out the terms of engagement or terms of employment you signed with the agency. If it doesn't have this written in it, make an official complaint Iin writing. I would! Good luck.

Certainly not !
I work contract via an agency a lot of the time, and if the hiring company has flexible hours, then so be it.
I do IT & such, and when last working in London, I could easily take a day off in appreciation of long hours put in to the system.
I dare say it is outside the bounds of your contract to withhold payments. Check the small print, but I don't feel that that threat is legal.

No they bloody well are not, have a look at your contract, if it is not on there they are just trying to scam you, that is the problem with working for agency's they think they are a law unto themselves, they are screwing enough money out of your hard work as it is, and now they want to squeeze some more.

Suck up to the company not the agency and ask them to take you on direct or get out of your bed earlier.

Your contract is with the agency and not the office you are working for....Like it or change the agency - your over a barrel on this one I'm afraid.

That's insane! They should know that the company you are working for has those hours. They should be pleasing their client (the company you work for) and not looking for ways to punish you!

they seem to do what they want these days i wid a agency and its pain working out my holiday pay
