I live in California. My need to use the restroom has never been an issue. Now because my bosses feel they have not met their financial goal this year, they are looking for reasons to blame. Case in point. They have now decided I take breaks longer than i should, and that is not documented and simply not true. At any rate, now they tell me if I go to the bathroom, if I have to just run to the bathroom real fast before a client is due in office, i am the only employee to 3 financial advisors, well that is now considered part of my 10 minute break. Is this legal, if i have to go pee, is this ok for them to subtract from a 10 min break for the time? and well we are talking about bodily fluids here, and what if you start your period, are you just supposed to sit there and gush now? geeeeeeeeeeezzzzzzzzzze. very uncomfortable situation for me, 3 men bosses ganging up on me today in a meeting telling me they are making these changes. I need to know my rights.

The law in CA provides for regular breaks depending on your hours. But that's not really the point here. If they are trying to get your to leave, you could sue them because what they are doing is 'creating a hostile working environment'. Now, if you were to go to the boss, and say this "I think these new rules about breaks are really designed to create a hostile working environment" most will run for the hills, because they'll figure you got that phrase from an employment attorney (I am NOT an attorney!), and they won't want to put themselves at risk.

But do remember CA is an 'at will' state. They can fire you for no reason at all - if they just want to get rid of you, they can tell you to leave tomorrow without giving a reason, and you won't have any case against them.

I don't mean to sound callous, but, honey, quit this nightmare job before these three morons make your life a living hell, if they haven't already. Even if you could prove that they were violating some labor law, do you really want to fight for the right to work at a place like this?!?

Get your resume' together, start emptying your desk, and get out of there ASAP. This may not exactly answer your question (sorry), but, it's my opinion. LIFE IS TOO SHORT.

try to get some sort of proof to claim what you have just said, but through legal means. Don't record their voice. I mean, through email, or ask them that you are ready to sign an agreement etc. Get it it signed. Then consult a lawyer.

Find another job. Find a lawyer and sue them for sexual harassment . Or say your having women problems, no man wants to dell with that.

they are very wrong and that is not legal,if they want to push the issue start peeing in the trash can at your desk so you can answer the phone:::no time away from work,problem solved...bet that would twist their heads..
