If you signed a lease, that would legally make you a "tenant". However, if she just allowed you guys to stay, I dont believe she has to give any notice. However, if your paying rent and have checks or rent receipts fir this month. Poss a cop or legal reprsenter will tell her she HAS to let you stay. I'm not completly sure, but I hope it works out for you. Is there family or friends that willl at least house you children for the next 30 days, or allow you aplace to stay during this holiday. And more importantly have YOUR BOYFRIEND speak to his mother. HE SHOULD be able to smooth things over for a couple weeks. Evene if you have to kiss her a** for your children.

Anyone allowed to live in a house by someone then has the right to 30 days notice to move out after eviction, period. If someone lets a homeless person stay one night, legally they can stay there for 30 days before he can be forced out.

This is why you should always, always, always have a standard lease/rental agreement. This way everyone knows their rights and obligations. If there is no lease or rental agreement between you, then she has every right to order you out now. It's her house, she is paying the bills and is held liable for whatever takes place between her four walls.

This is not a tenancy in a separate dwelling; you are simply a guest in the house, and the owner can ask you to leave at a moment's notice. Pack your bags - you're leaving.
