It's only rape if you have some kind of sexual interference with a minor. But just f.y.i... why not just stay clear of her until she's older?

Telling someone you love them is a good thing when:
1. You mean it.
2. You have no hidden agenda behind saying it.
3. You are a parent, guardian, or relative.

If however you are touching that child inappropriately it would become statutory rape. You do not need to actually have physical penetration to be charged with statutory rape. Any for of inappropriate sexual activity could find you behind bars for a long time and justifiably.

But to say you love someone and to show someone that you love them in appropriate way is the best gift you can give a child. Love is the most important thing a human being can ever give or receive.

I just worry that anyone who would ask this question in this context has a hidden desire which scares them and that would suggest that possibly they may act out on it if they allow them self to get too close to the child or minor. If you have such a fear stay away protect yourself and the child please.

No, it's usually not considered statutory rape until the minor and non-minor have sex.

If the minor is, say 17 and you're 18, then no. But if you're considerably older than the minor, you're nasty. Find someone who is over 18.
