In most states, no, the spouse's assets/income are separate and cannot be considered when calculating support. However, if you have proof that he is "juggling the books," this should by all means be brought to the court's attention, as it's completely illegal (for purposes of assessing child support). Keep in mind, though, that if he's already ignoring the support order, he probably won't hesitate to ignore any future orders. Go for garnishment (if your state allows it) and request a lien on his property, any businesses, and/or income tax refunds. Be merciless: He's certainly showing you no mercy, and you've got at least ten more years of this to deal with.

I think it depends on how long ago he died. Once someone dies, there is (depending on what state you live in) about a six month window to bring a claim against the dead person's estate.

Dying does not get you out of paying your bills. Before anyone gets any part of an inheritance, creditors get paid out of the estate. If someone dies owing you money, you might still be able to get it, but it depends on how long ago the person died.

You have to sue the estate, if there is any money. If there is no money, your case will be closed and arrears cleared. (Can't get blood from a turnip...)

You could possibly sue his Estate...if there is one. It also depends on how long he owed this debt to you. You don't say how old the kids are, etc.

LOL. you can't sue someone who is dead. why would you want to sue your own spouse? yet sue him now that he's no longer living? i really can't stand it when people see beyond what's really important just for money. Why don't you just find a job & deal with it & why didn't you talk to him about it before he died? why did you wait till he died? it's too late. You can't do something to someone that's not living anymore.

Yes....you can sue the estate of any person oweing you money.

If the estate has money in it, you may be able to tap into that, have your attorney check into it.
