The only way I could see them being able to do this is if there is supposed to be a fence around the pool and there was none AND there is no leash law for dogs in the area. I would definately be checking both of these things out if anyone of these pertain to you. This really stinks and I still don't think its fair regardless.

I would say that they could only by her trying to save the dog but then she could get it put down because it bit her. If they are suing her there pretty stupid because there dog jumped the fence but it could go either way when you look at it.

They can try, but your girlfriend needs to slap a countersuit on them for medical expenses, and make sure to include pain and suffering. i don't see how they could be suing your girlfriend. the dog came on her property, jumped in HER pool, and CONCERNED WITH THE ANIMAL'S SAFETY, made an attempt to help the animal. she didn't do anything wrong, nor anything cruel.
this doesn't make any sense.
i hope this situation comes out in your girlfriend's favor.

firstly sorry to hear that about your girlfriend. they might try to sue your girlfriend but they know that their dog trespassed and they should have taken measures to keep their dog in their grounds while they were away at the time. so i think you can use that to countersue them and claim back for the medical expenses.
