His not having a job means more than anything else. If he can provide for your daughter, then that is what will matter. Put another way, if he can easily get a good job, it will make a difference. Your being in the army could hinder your case unless you can give specific details regarding your daughter's care while you are away on duty. What it boils down to is who can care for the child. It's not about education. It's about child care.

Custody battles aren't fought on educational backgrounds. The addenda is the more important.
If you are enrolled in the army, you have a job. If your ex has no job, that's a big strike against him/her. On the other hand, if you are in the army, who is going to be the caregiver if you are sent overseas? Or for that matter, who is the caregiver while you are at work?
I have no idea what your 'one dought that is 1yrs old' refers to. Are we talking about a child? Some kind of pet? or ????

It depends on what state you are in. I would recommend speaking with a custody investigator in your state, however given the fact that you do have a full time job and she does not that looks good for you. Other things to think about in going thru your custody battle is credit history, family history, domestic violence (is there a history of?) there are a lot of factors that go into a custody battle other than financial history or job history. If you would like to talk more about the situation please feel free to send me an email or post more information here. I am a single mom of 2 kids and went thru long custody battles with both of them. email is alaskalillady@yahoo.com

As sad as it it most courts are going to award custody to the mother. Based on the fact that you are in the army is not going to be any help to you. You definitely need to go talk to a lawyer- they need more specifics than what you can give here. And most of us aren't lawyers.
