I think you have to have been married for at least 10 years. If so she is entitled.

I am not sure of death but if he had not died but only divorced she would loose access only after 10 years.

Call the social security office. They will tell you what she is entitled to.

Depends. Was the marriage of your father to your mother his first marriage?

My uncle divorced my aunt after 20+ years of marriage. Then he remarried. When he died SHE got his SS not his second wife. I believe if a man is married to his first wife for 15 years or more it is the first wife that gets the SS benefits at his death. At least that is the law in CA.

She should have began receiving his SS money when he died she didn't have to wait till 65. See an attorney and get the back payments and regular payments started.

Your mother should have gotten it at 62, as long as he was never married before her -- then his first wife (if still living) would get it. It does not matter if your mother remarried, or how long she was married. My great-aunt receives social security on my great-uncle, her second husband (married less than 10 years but first wife was already dead), and her own. My dad's stepmother also receives social security from my grandfather, as well as her own.

Your mom could have started receiving it as early as the age of 62. I know I work for SS in finance

It depends. Was he paying into SS when he died? Did your mother remarry? Has she applied?

It depends on a woman's age. Your mother should be drawing his social security unless she has remarried.

She does not get his social security number, everyone in America has their own. And only one for life, expect for very serious circumstances. However, I do believe if your father had any social security benefits, she is entitled to them upon her retirement. Good luck and God bless****
