As long as you're not hacking a secured wireless, it's legal in the US. The debate rages on, however. Some localities have tried to bar it, but the FCC maintains control over the radio spectrum in the US and has NOT addressed the issue to date.

I don't think there are any laws against it, maybe on a local level. If you "hack" a secure WEP, then maybe you could be breaking a law, but unless they bring a civil suit for privacy invasion, you should be ok. Plus, anyone with an unsecured network, would most likely not know anyone unauthorized was on the network. Or they would just block your MAC address or something similar.
