My sister got a divorce without her husband's signature, if you go through with the divorce and she don't show up to contest it, the judge will find in your favor. You will have to wait 90 days after filing to give her a chance to confront the judge or her lawyer and if neither one does, the divorce is final.

In some cases you can get divorced if you do not know how get in touch with your spouse by placing a notice in the paper and giving them the proper time to respond. A lawyer in your state should be able to advise how to do this.

In some states, you can post it publicly (the divorce) for a certain amount of days and if the party does not respond to it, you can proceed with the divorce. You need to speak with a divorce attorney in your state and county to find out more info. Good luck.

This is a very common problem. If your husband refuses to leave you then the only thing you could do is go to court and give out reasons why you want the divorce - maybe prove to the judge that he is dangerous and that your life is in danger as long as you are around him.

Where do you live? If you live in a no fault state then you don't need anything to get a divorce.

Call an attorney to find out.
