I live in a house that my friends own. It is a three story victorian, I live on the second floor, they live on the first and someone else on the third flloor. The third floor tenant has garbage on the second floor landing ( there is a thin wall that seperates my living room from his landing). This garbage has been there for a few weeks at least and is smelling my entire apt up! It smells really gross in here. The landlords have repeatedly told him to get rid of it, as have I. Is there anything else we can do?? We are both at our wits end as to how to get him to take care of this!! If I called the Dept of Health would they come back on the landlords, even though garbage removla is not included in the rent?

I would have taken it out by now But he has a locked entryway!! I cannot access it through my apt. but where he put the garbage is right on the other side of my living room wall! The landlords want to evict him, but are not sure that they have enough with just the garbage alone.

Very sticky situation - pardon the pun! In every state of the union, the landlord has the right to enter his/her property provided they give at least a 24 hour notice. If there are locks that the landlord does not have keys for, they have the right to call the police and proceed with what is called a 'civil standby'. Tho' the police are not needed for this, it's best to do it. They can then break the locks. I agree with most everyone else, take it out yourself for the time being - the time being meaning while eviction proceedures are going through.
If the person(s) above you are 'fine' aside from this, just talk to them! Invite them down for a spot of tea! Let them smell what you have to endure. After a minute or so of them being there, tell them, 'please excuse the odor, but somebody keeps leaving their trash out by our door!' Eviction is the last resort. Some people really don't realize what they are doing to others until they are faced with it. Don't leave notes. Use person to person contact and be at ease! If they refuse, use your imagination to 'get 'em back!'

Don't call the Dept of health, have your friend who is the landlord mention it to him again. If he doesn't remove the garbage, then have your friend evict him. I am not sure about the state laws in the state that you live in , but in my state you go get a constable to issue an eviction notice, and he will have 30 days to move out. Also tell your friend, the landlord, to take pictures of the place and the trash just sitting on the landing. Now mind you he cannot just go in the place even though he owns the whole building but he may be able to get law enforcement officials to accompany him so he can get pictures of the state of the residence. This is done in case the person decides to tear up the place before his eviction date comes around.
Also I would suggest that your friend the landlord have an attorney draw up some rental agreements for the next tenant that is to move in. Have them put it all in a binding contract that the new tenant will have to sign and honor, or else get evicted also. In the meantime I wouldn't make a big deal out of the problem with the tenant because you don't want them to make any trouble with you or your landlord friend.

It would come back to the landlords. This is why most of them include it in the rent - they usually end up doing it anyway. His only recourse is to start eviction proceedings, and then the tenant will really trash the place, and probably leave the windows open with the heat on. I wouldn't be a landlord for all the tea in China.

All things considered he lives over your head does he make excessive noise or cause other problems for you or the landlord if he/she is otherwise a good neighbor/tenant then take out the garbage yourself. If it happens again then ask for the landlord to help you. Try being a good neighbor instead of a wuss.

Once when this happened where I lived the landlord opened up the offending persons apartment and put the trash in their living room. They took it out after that. The landlord needs to add something about trash to the lease.

Call the local police and let them document the activity(or lack thereof) so the eviction proceeding will go smoothly. That will cut out the he said, she said b.s. It may STILL take 90 days to get them out but some things are worth waiting for. It would really suck to have that kind of tenant/neighbor

I think in this case, I'd just take the trash out to the rubbish bins whenever I saw it sitting there. It's not worth the aggravation, and it's not worth having a stinky place. The only other thing would be for the owner to consider new tenants.
