Is it illegal to refuse to move when the space is needed for someone in a wheelchair?

It is not illegal to occupy these seats or spaces but it is a breach of Rail Vehicle Accessibility Regulations 1998 not to give priority to disabled persons.

I commute every day and have never seen anybody get into 'official' trouble for being in disabled seats. What I do see is people barging their way onto packed trains at the last minute just as the door closes, heedless of the possible impact on others on the train. I once saw a little old lady squashed against a fold up bicycle; she spent the next five minutes screaming about somebody trying to break her legs until people got off at the next stop.

About disabled parking spaces (a bit of topic but need to correct and have a bit of rant)...

In Wandsworth at least, the majority of roadside disabled parking spaces are not legally enforceable. Do be fully active they need to have a disabled sign post as well, but this costs more for the Council. What is illegal however is all those poor disabled people who need to use traffic cones to try to stop people parking there. The legal solution is to ask the Council to make your disabled bay permanent.

I can imagine able drivers parking in disabled bays because they do not know if the disabled person is still living there. I reported the needless parking bay outside of our house to the Council. A year or more later, nothing has been done about it.

Sorry, must be in a ranting mood tonight.

I don't think it's illegal but it's rude. The person that said the thing about the parking space thing is off. Think of it like the stall in the bathroom. If no one else needs to use it that can't use any other space, it's up for grabs.

it is not illegal, nor is it illegal to park in a disabled space in a private car park. it is bad mannered, and will breach the rules of the car park or the train, and when you bought your ticket you will have agreed to the operators terms and conditions of carriage, which will allow them to fine you, remove you, boot you off the train, but if you refused to pay the fine, it would be dealt with by the civil courts, not the criminal courts and the police would not get involved

Depends on your morals. Sign does say "please" Same applies to drop down seats on buses for people with a pram. So it's not illegal. Depends on the morals of person involved if he/she moves. Tho why anyone would want to sit in disabled space and leave passenger who needs it, would do that. Can't figure out there mentality.

not illegal not rude just use common sense

i shouldnt be a problem to sit on it if there are no other seats available , but you should give it up if required

it would be rude if you didnt move if a disabled passenger came into the carrage

Nope. As the person above said, it is just common courtsey to move should the seat/area need to be vacated to allow a disabled person the seat/area.

No it is not illegal but it is being a 100% *** hole to refuse to give it up,who would be so low to do that anyway.

It is not illegal, but neither is it illegal for the train company to remove you if you do.

yes. thats like using a handicap parking space. You can probably sit there as long as nobody needs the spot... but to refuse to move could get you a ticket.
