I have been diagnosed with second hand smoke disease.(proven by lung surgery and samples) I HAVE NEVER smoked nor do I allow anyone to smoke in my house or cars and I was raised in a NON SMOKING FAMILY. I got it while working amongst the prisoners that, at that time smoking was allowed. Have there ever been any cases taken to court for the "TRUE NONSMOKERS". I am curious to find out. It has been 8 yrs since diagnosed. Please only answer with intelligent answers, as I am not into ignorance and stupidity. Thank you

I think you should get legal advise as if you can prove that you were brought up in a non smoking house and have never smoked, you should have a case to take legal action. Lets face it these days legal action is taken for much less than this, so it would be worth looking into.

1) Track down other employees from the same time frame and see if they had similar experiences

2) Set up an appointment with an attorney and ask him about it.

I don't believe any non-smokers have made a successful case... but I could be wrong.

the burden of proof. Ask in the Law and Ethics area. I wish we knew why some people get lung cancer from smoke and others don't...Good luck on your quest. God bless

Who are you planning to sue? The prison or the prisoners? It's too bad that the vocation you chose made you sick. I guess since we're such a better world because of lawyers, someone has to pay for what you chose, huh?

you can call an attorney in your area for a free consultation, they can be very informed. they would know exactly what you you're asking. they usually do it over the phone it's not like you'd have to go anywhere

I do not know of any, however, believe you should look into this. I think you may have a case here.
