I work in california and was wondering if there is a california or federal law on when a company should provide insurance benifits for a full time worker? My friend has been with the company over a year and still has no benifits...i know most companies give it to you after 60 or 90 days probation even 6 months but is there a law about how long they should take ?

the company doesn't have to give him benefits at all, unless they stated that they would do so, but there is no law saying that a company has to provide people with benefits at all

In California, there's no law that even says a company HAS to provide you with benefits at all, and there's certainly no legal minimum probation window.

Exceptions to that of course are benefits such as Workers Compensation Insurance, which must be offered the day the employee begins working.

But if you're speaking of Medical, Dental, Vision, etc....there's no legal minimum time period. If the company wishes to offer benefits but requires the employee work there a year before they get benefits, that is entirely legal. If they wish not to offer benefits at all, that's also legal. If they wish to begin those benefits the day the employee starts...yep they can do that too.

If your friend wants benefits and is displeased with the company's "probation" period, I suggest he/she find a new job that has a shorter (or no) probation period.

1. Are you sure he's a full time worker? sometimes companies get around stuff like that by working 35 hours a week

2. go to personnel and ask about benefits.

if he was hired with the promise of health benefits, then he should be getting them.

if the company doesn't offer health benefits to its employees there is nothing he can do
