No, real Talent Agencies cannot afford to scam professional actors.
They are overseen by the Department of Labor of each state.
They are members of: http://www.agentassociation.com/
Do your homework before you go to a Talent Agency. Educate yourself about the industry before trying to find an agent.
If you are non-union, you are more likely to be "taken" by an agency.

The advice told to me long ago is if they ask for money up front from you, they are scamming you. Reputable agents will take a cut of placements as their fee (a percent).
