ARTICLE 11.

As the government of the United States of America is not in any sense founded on the Christian Religion,-as it has in itself no character of enmity against the laws, religion or tranquility of Musselmen,-and as the said States never have entered into any war or act of hostility against any Mehomitan nation, it is declared by the parties that no pretext arising from religious opinions shall ever produce an interruption of the harmony existing between the two countries.

The Founding Fathers signed the Treaty of Tripoli because they were no longer under the protection of British trade treaties, and thus had no access to the Mediterranian, controlled mostly by Tripoli, Algiers, Morocco, and Tunis. Tripoli demanded yearly tributes in exchange for use of their seas, and these tributes were at times excessive. In fact, Tripoli had taken many American hostages, and they declared war on the US at one point. Kind of an interesting part of history. This is the atmosphere that the treaty was forged in.

Article 11, usually cited as a defense of the Seperation of Church and State, is a different issue. If your question is about it, go ahead and ask.

Seriously, they signed the Treaty of Tripoli after the successful conclusion of the war they declared on the Barbary pirates operating out of Tripoli.

The war was declared because they were attacking our merchant ships, and we refused, to the shock of the European governments, to pay tribute to the pirates like the Europeans did(le plus ça change... )

But that was a treaty with a different government that no longer exists.

Not sure why the religious aspect is brought up, except to further differentiate the US from the Europeans.
