It actually is NOT assault. It would be considered Battery.
Battery is to purposely intend to make harmful or OFFENSIVE contact with another person (and of course make that contact).
Assault would be to purposely cause apprehension (aka fear) of harmful or offensive contact.
They go hand in hand but the contact clearly makes it Battery.

Yes. It is definitely a battery if you intended to do it. It may also be an assault if the other person had a reasonable aprehension that you were going to spit on them and you had the present apparent ability to do so.
Assault/Battery can be charged as crimes or torts and may be tried as crimes (minor) or civil wrongs.
