I am a cook at a restaurant and 3 months ago I fell while in the kitchen while cooking because the floor was wet, and when I fell the biggest pot in the kitchen fell on my head. I did not feel any pain at the time and my boss would not let me go to the doctor she told me to apply ben gay when I got home. Now I am constantly having headaches, knee-pain, and problems standing for a long period of time. What can I do?, what are my options? Please help me

Talk to a lawyer- your boss said you couldn't go to a doctor? A little illegal don't you think?

You may be SOL. I work in a restaurant, too, and can tell you that you made a BIG mistake by not going to the doctor IMMEDIATELY, if for no other reason than to have a report on file of the incident - which would have covered you for injuries even 3 months after the fact. I suggest you call the number (which, by law, should be posted where you work) for Workmen's Comp, and tell them what happened, and do whatever they tell you to do. Good luck. Your boss was negligent and stupid - but you didn't exactly use common sense, either.

Its good you reported it. you can now prove it happened.you must go see a doctor.exagerate the pain some or the doctor wont treat you properly.then call a lawyer. or get the phone number of the insurance company the place you work has and tell them you were hurt.then go see a chiropractor and get treated.on a regular basis. get an mri or some other x rays done. a lawyer is best.to have on your side.get a doctor to say you shouldnt work.,stop working.get workmans comp.you will get a lot of money.a few years from now. in a settlement.Its best to take care of yourself. no one else will.Good luck

You need to check out your workers rights, if you can't get compensation, you can probably just sue the lady for damages. Threaten to do so and also threaten to bring in a health and safety inspector, you might be able to get a settlement outside of court. In the meantime go to a doctor, you might have a fractured skull or a concussion.

Go to the doctor and get it checked out. Ask your doctor whether the pain and the incident are related. You can file a workman's compensation claim and/or personal injury claim.

Most workmen's comp claims have to be filed within 72 hours of the incident. Talk to the HR department, they should be able to help you out more.
