No, you cannot sue based on his diagnosis. You can only sue for malpractice IF a doctor prescribed medication which made you severely ill or altered your physical ability or lifestyle, performed a surgery which also altered your ability or lifestyle or performed the wrong surgery or any other treatment which altered your normal lifestyle. This is why it's best to receive a second and sometimes a third opionion.

yeah, but it sounds like you didnt really suffer any serious harm though due to his negligence so i doubt youd win a significant amount of money, if any at all. especially after you pay your lawyer 1000s of dollars. did he know you had been in an accident of some type in which case he should suspect a concussion? if he didnt know that, he probably made a made a pretty good faith effort and in most cases he probably would have been right. medicine is a gray area, things arent cut and clear and you shouldnt sue somebody everytime they make a mistake. but if you want to go talk to a lawyer he could probably give you better information than i could

this is the perfect reason to always get a second opinion if something doesnt feel right..as for suing theres no grounds for it,unless something was prescibed that aggrevated what issues are going on then maybe...but even then the hassel of a law suit isnt worht it,remember lawyer always takes the first and biggest cut

I am pretty sure that if you try, you will come out on the losing end on that....before you hire a lawyer, and pay court costs, you should think it threw real well....hope you are doing better now.
