These problems usually occur because strings aren't ideal vibrators - when you fret them they get stretched out of a straight line, and this makes them go sharp. To overcome this, normally the bridge saddle is placed so that the scale length is a little longer than the theoretical value from which the fret spacing is calculated. When the saddle is misplaced, much too high, or poorly contoured, the guitar will sound more and more out of tune as you go up the neck. This is easily checked with an electronic tuner. If that's not what you're seeing, the problem may be at the nut end - perhaps either the nut is so high that the strings are being pulled WAY out of line, or the slots are poorly contoured so that the strings are leading off the wrong place on the nut (or even not touching the nut at all, although that's not too likely considering the angle at which most acoustic pegheads are set) . It's hard to see why you would hear a problem at the second fret and not the first in that case though, unless you're confusing the open string with the first fret. Anyway, you should take it to a guitar tech for a hands-on diagnosis. First, though, a new set of strings may be in order, especially if yours are very old. Strings lose their elasticity as they get older, and this can make intonation problems worse. If new strings don't fix it, take it to a tech. It's safe to say that the problem is NOT with your fret spacing - they are cut by automated equipment and errors are highly unlikely.
