No, there is not enought alcohol content just in what you are swishing around it your mouth to register a .08, which is the legal limit.
Although, gargaling while driving would probably explain why you got pulled over in the first place...

Only if you were gargling Listering to cover up the smell of an excessive amount of alcohol you were drinking just before. Listerine alone isn't enough to cause you to fail the test.
