as our contranct with the employee says that their is a 2 month notise period before leaving the job

First, check with a legal counsel that the 2 month forewarning clause is legal and enforceable.

Second, see what you can do to make staying (or delaying departure for 2 months) is more desirable than going over to the new job.

Overall, I fear your prospects are not good at all, as I know no laws forcing a body to stay in a crappy job when he finds a better one, and I doubt labor law, or even contract law, wherever you are would support your case.

I'd like to be kept informed of your case if somethinginteresting develops, for the sake of my culture.

Even if you could make him stay, would it be worth it? Do you really want someone working for you who clearly no longer wants to be there? Is it really productive to keep an employee there against his will?

I suppose you could take legal action, but unless this employee is pulling in lots and lots of customers for you, is it really worth the time and the hassle and expense?

You can't actually do anything. If the conditions and terms of the job would have been better for that employee, they wouldn't have been looking for another job in the first place. Say goodbye and wish them well!

He's gone, no law or contract can make him stay.

Wish him luck and an offer to come back if things don't work out.
