isthis alegal arrest ? Also no miranda warning given even after request for them.

Roadside tests must be properly implemented. If procedures are not observed, the police officer could be complained so that appropriate action can be taken against him.

You can refuse to do either, but that will result in your license being suspended for one year and you have no recourse to speak of. But it is not illegal, because the cop is conducting an investigation, you will be given your right once you are placed under arrest.

In Malaysia, I dun think that you have a choice, but just to abide by it. Anyhow, by performing roadside tests, I dun think that it amounts to a legal arrest.
