i was riding in the front passenger seat of my moms car and my friend was driving. we got pulled over and they found a roach in the ash tray aqnd charged me with it. how will they prove to a jury that it was my roach? what tactics do they use? will i get off? the driver was chaged with operating under the influenze of marijuana.

If the driver was charged with an under the influence offence, did he also get charged with the possesion? If so he would have to go to court on your behalf, and not only say the roach was not yours, but also say you didn't know it was in the car. I'm assuming you smoked part of it and knew it was in there. It's going to be a hard charge to get dropped, and your friend would be under oath, so he better be telling the truth if you didn't have anything to do with it.

For them to find thedoobie in the ashtray, either the tray was open, or the doobie was smelly enough that they were actively looking for it. Either way, it means the roach was fresh, and they have strong presumption against you and your friend, it is up to you to prove you had nothing to do with it. And shame on you if you want to push guilt onto your mom, even if she really was the culprit.

If you truly were innocent, the best way for you is to take drug tests to show you have no traces of THC in your system.

dude ya gotta blame it on your mom next time, let her take the fall. The approach for the roach would be to prove you had access to the ashtray, withen reach.

You should get a lawyer and get the charged reduced, its called a plea bargain.

Next time you know if you get pulled over keep your mouth shut and ask to speak to a lawyer.
