My co-worker seems to think that they would get away with the murder because an innocent person can not be punished. She says she heard it on some trivia show a few years ago.
If it was a planned murder, however, I think that the other twin could be charged as an accessory to murder for not reporting the crime. Then they both could be put in prison for two different charges.

As for being charged with murder as well? I doubt it. After all...two brains -- two people. Besides..the charges wouldn't "stick"
Seriously though, if there were no witnesses, how would you know which one did it? DNA..don't think so. Geesh, can you imagine a white Bronco chase with them at the wheel? Untastefully funny

If the other half, the good one, did not do anyting t try and warn the person or try and stop the murder, then they can be charged with being an accessory to the crime.

i guess not in law, but technically yes...
they'e have to punisher the one either w/ jail or death penalty, and both punishments are bad for the innocent one
