It's .08 and then 0 tolerence for those under 21. I had two MIP's (Minor in Posession of Alcohol) when I was under-age for simply being at a party and then when I was at a dance hall where there was alcohol. If your in reaching distance then you can be charged unless your legal guardian is there. Even though I took a breathalizer test and passed I still got these charges. And they aren't a slap on the wrist. I had to pay a fine of $250, take 6 hour (that was $50) of Alcohol awareness classes, write an apology to the officer, my license was suspended and I had 8 hour of community service. So just be careful...if the cop wants to be a dick then you can get really screwed.

The legal limit for 21 year olds is .08 anywhere in America and 0 for anyone under. It's a federal statue
