I would say that it certainly isn't based on the Constitution, which is the supreme law of the land. Sandra Day O'Connor went to Europe to study how European law is adjudicated. I guess she didn't realize that our law is based on the Constitution, not European law.

Some think it is based on opinion and some think it is based on fact. There, that should answer your question. What do they teach you kids in school anyway?

its probably based on the law. Im just guessing though.
