Which one is correct and why? what is the difference?

"If it were the case that I DID not"...

Seeing as how "were" is past tense, you must make the verb "do" past tense as well.

I think that "If it were thr case that I do not" is the correct one, because it's the second condition of if in the form of "if I were...
I do not really know if there is a reason saying "were" in the second condition or not. Good luck!

If you use the word "was", you are stating that the act is over and done with. If you use the word "were", you are stating that the action can still be going on.

proper usage would be...
1. If it WERE the case that I DO not
2. If it WAS the case that I DID not

You know, I think both are correct. You have an "if" clause here and I think the use of "were" is the grammatically correct usage of the subjuntive mood, although it's not as common in modern day English.
