ok ok here is the details.

Today I was pulled over with a group of cars in route to a "toys for tots drive". We were driving 35 in a 40mph zone so the motorcycle cop decides to pull over the person ahead of me. So I decide to overtake but then realize he is flagging me down as well.

So we all pull over, (a group of 8 cars) and he comes upto me and says "license & registration". I then give him my registration and as I am doing so my cigarette falls out of my hand in front of the cop. So I then goto pick it up, as I am doing so he said you might want to pick that up. He then proceeds to cite me for it.

Q1: If you pick up the unburnt cigarette does this still apply?

Q2: How/What would be a way to fight it?

Q1 I would think not.
Q2 There should be on your ticket (the back) a court date to fight it.

The only way you could fight it would be if it were on video tape, and it may or may not be. Even then, your chances are slim. Yes, it DOES still apply, even if you pick up the cigarette. If you really want to spend the $20,000 or so that it will cost you to fight it, then hire an attorney. However, it is VERY unlikely that you will win.
