i seperated from my husband in july but the house is in both our names on the tenancy and he wants to move back in. i have been advised to get a non cohabitation order but i want to know what it entails before i go through with it as i don't want to stop him seeing his children

All it means is that a judge is overriding the joint tenancy agreement you have with your landlord and is telling you and the landlord that he legally has no further rights to live there and you can evict him, and/or have him arrested for trespassing if he won't leave willingly.

I would definetly do this if you think he is going to cause a stink when he has to leave. He can still see his kids but he can't live there anymore. GL

basically he can not live under the same roof, he will be able to see the kids

It just means that you can't live together....he can still see his kids
