I heard it goes on what the parents makes, and what they could make? My sons father had a masters degree and a $25/hour job but chose to only work part time for the past 2 years. Now he owns his own business and im not sure how you even figure income when you own a business. He claims I would be lucky to get $400 a month for my son. My son is almost 2, and we are just now considering child support due to our not so good circumstances. Any information would be helpful, thank you!

Also... we were never married. We have been on and off in a relationship since the time I got pregnant. So he definately has not always been around and been supporting our son. When things were ok he would supply some things, but all the times we were apart he would maybe pick up some diapers. I think one time he did give me $150 for a month...

i am sure that child support on the east coast would be based on a percentage of his income. the child support agency will look at his tax forms and make calculations based on that. in wisconsin, it is 17% for one child. if you find out he is fudging his tax returns to keep from paying child support, you can contact irs and the child support agency.

Each county has a Domestic Relations Dept. that you should contact. It is totally free and each side will be asked to meet and share finance situations. They will ask for each SS# and contact his/her employee'r and get W-2 info to show current and past info. Dom. Rel. will give you some idea of payment.
If an agreement can't be reached by both you and he, then a court date will be set. Court fee's will usually be split by the 2 of you. A judge will ask if an agreement has been reached if not he will take in count both income's, who pays the bills such as health care, food, shelter and any other reoccuring bills for the child. An attorney is not needed, but usually suggested, only sometimes needed though.
But afterwards you will see an attorney is a waste of money in this situation because the judge decides everything. Attorney's may say a few words to impress you and show there involved to earn there money.
One suggestion go to a consultation (sometimes only 50.00) and tell attorney what you think he makes and he will give you an idea of payment, that will give you some bargaining info to ask for help from the child's father. On main thing a judge will look at is, is the child in school or day care, if so do parents live in the same school dist. or area , where does the child spend nights(doesn't matter where they are during the day, it's where they sleep is the main issue).
Lastly the State of Pa. has a web page to help get an idea of payment, possible under Dom. Rel but not sure.
Also keep in mind the money is for the child, (food, clothing,roof over head) not for the collecting parent to purchase there much wanting things. Even though no state ask's for proof of what the money is spent on.

Typically speaking, the judge can do several things: he can impute an income to the spouse based upon his prior income (usually the average of 3 years, sometimes based upon a 40 hour work week), and fix the child support at that amount. He can also order the parent to post a bond against the child support.
Also, is this a partnership, sole proprietorship, or a corporation? I'd try to get your lawyer to get a copy of all their financial records.
Last but not least, the only person you have to believe when it comes down to child support is the judge. The NCPs opinion of what the child can get is irrelevant.

First I would have to agree with JT. its best to have an attorney, second, child support is based on the supporting spouses income, also if you have custody, you can also claim head of household, this will also come from the supporting spouse, this will apply to they are 18, another thing , if the child plans on attending college, the state requires for the supporting spouse to maintain health insurance for the student so long as that student attends the college they are going to

LORD girl what took you so long?!! your baby needs things. buying diapers and items is nice, but thats NOT supporting a child.

in any case, the honor system does not work so a court order is what is best for your baby.

yes, they go by both parent income for the figure. most states do (mine NJ does).

contact your local legal aid office; they are in all states and most counties. it should be in your phone book or call the county court clerks office and ask if they have the number. they go on a sliding scale, so its free to most.

Yes, child support is based on income. And whether one is employed or self employed, federal tax returns are a fact of life. That is how income is determined. Do not put any stock in what 'he' (your husband) says. I strongly suggest you consult with a competent divorce attny.
