If a man/woman does a sex change is it still considered same sex marraige? What do they have to do to legally change their sex from male/female to its opposite? How easy is it to doctor one's birth certificate? If you have a name that both sexes can use (like Kelly or Alex) and change your appearance, is it easy to trick the system? Or should you not even go there?

If a man or woman fully and completely changes his/her sex and is recognized by the law as that sex, they can legally marry someone of the opposite sex. That is to say, a man can transition to a woman and then marry a man, or a woman can transition to a man and then marry a woman. They cannot, of course, marry the same sex as their new sex, unless they are in one of the precious few states that recognizes homosexual partnerships.

What do you have to do to legally change your sex? Well, it depends greatly on the state you live in and their laws, but most will recognize your new sex if you prove to the courts that you have went to full measures to change and are living as that sex (usually you must provide proof, like a doctor's prescription for hormones you are taking). They will allow you to change your sex on your driver's license and all other official documents, and from then on, you will be considered male or female in the eyes of the state.

How easy is it to doctor one's birth certificate? I have no idea, and I don't suggest you do that. Even transsexuals don't change their birth certificate . . . it's rarely used much anymore as a form of identification, you just keep it hidden if you don't want anyone to know. If you're thinking that you can change your birth certificate and go about saying 'Whoops, there was a mistake, here, look!', it just sounds risky. Go through the proper channels; don't trick the system.

I don't know if transexuals do get to become legal entities of their new gender.
