You could legitametely sue the Robber for the tort of Assault, but you wouldn't likely get any money from him. You have the right to file a lawsuit against anyone for anything at anytime, so you could go after the deep pockets of Burger King, but that would just be a slimy thing to do. I do not know what kind of suit you would file against BK, since they did ABSOLUTELY NOTHING wrong. I find it despicable how many people file for torts when there is not a valid tort that was commited, I also believe that if a case is thrown out as frivolous the plaintiff should have to pay ALL court fees and lawyer fees of both parties.

Grow up, and stop being such a d!ckhead, sh!t happens and the sooner you learn that, the sooner you will realize that just because bad things happened to you it doesn't mean that someone owes you a wad of cash.

Sorry to hear you got rob and at gun point. However, you think the robber is going to have money after robbing people for your law suit? Do you think the robber is going to give you money after a law suit? You might want to rethink your plan against this robber. Jail time is probably is the only thing that the robber is going to be prevented from robbing people for awhile. Suing Burger King for getting Robbed is a grey area, but it was not the restaurant fault of robbery. However, they should at least give you something worth the cost of being robbed at Burger King, I think. Good Luck though.

The ONLY way you could have a legitimate suit is if Burger King planned to be robbed on a regular basis and didnt post warning signs for their customers. As I somehow doubt this was something they wanted to have happen they had no control over the situation and cannot be held responsible.

Outside of the direct question though how much of a dick do you have to be to even think that they would be at fault?

It is people like you that give Americans a bad name... the rest of the world thinks that Americans just sue everyone.

Be thankful that you didn't have your brains blown out. Get up off your *** and start your own business and make something of yourself rather than trying to sue Burger King. Once you have your own business, wait for some leech like yourself to come along and sue you and take all your hard-earned money.

Learn how to spell and that might help you in these endeavors.

Good luck.

Toward Burger King? Probably not. Maybe if they catch the thief. You could win something, and most lawyers will want you to pursue charges based on "...as a customer, the contract of keeping the customer safe was not forfilled..." or something in that manner. But if you lose, you will lose a ton in lawyer fees etc. I wouldn't.

If they catch the guy, then sue him.
Just be glad your alive and not brain dead.

If you come to my court with a suit against Burger king i would throw you out with a bill for court costs and a settlement for BK for wasting their time and mine.

Sue who?

Burger King? For what? Because they were open for business?

The robber? For what?--because he obviously doesn't have any money or he wouldn't have been holding up fast food restaurants.
