Not if you gave it to them. If you can prove that it was just a temporary thing in that you only wanted them to watch the pet for a little while, or that they have stolen them then yes you can. Go talk to a lawyer about it and tell them the exact details. A consult is free.

I imagin you can take that person to small claims court, but you would have to prove that you had every intention of reclaiming the pet. Also you would want to do this as soon as possible, because pets are looked at like any other property and the longer you leave it alone, the longer you run risk of the animal not being returned to you.
Also though think, what is in the pets best interest? Do they have more room to run around there? more attenion? better food? a better home life? In general of their life is going to be better there you should keep them there and look at adoping a new pet. If not though, good luck on winning your animal back.

It wasnt Stolen If you GAVE it to them.Once you give something to someone It is thers to do as they wish unless you had a contract that they broke....If they were Keeping the Dog for you because you couldnt or something and said they would give it back Then you have a leg to stand on..You can take them to small Claims court BUT, Be prepared to pay them back for any Vet Bills they have paid...and so much a day for Food and Boarding.From What you posted it Says You GAVE it to them...Could you elaborate Maybe we can get the big picture and edit our Answers!!!!

If the person STOLE your pet, then yes, a pet is property and you can press charges for theft.
If someone BORROWED your pet and now refuses to give it back, you can press charges if they refuse to return it or pay for it.
If you GAVE your pet away and now want it back, there is nothing you can do.

If you GAVE your pet to someone, then they own it. It no longer belongs to you. If your intention and agreement was a temporary arrangement, then you have to have strong evidence and witnesses to that fact before you can file any charges.

You sure can! Even a verbal contract should hold up in court. If you can show ownership of the dog and there is nothing saying you gave it to them, they cannot withhold the animal from you unless you left it with them for an extended period of time, didn't provide for the animal, didn't check on the animal, etc. I've seen cases like this before.
