I am owed about $7000 by a person and I am wondering what is the best way to collect the money from him? He is refusing to answer his phone..

I live in California and he lives in Georgia..Would it be easy to file a claim against him? where would I file the lawsuit against him at? Here in California?

Small claims court. But you need to check the limits in your state, as some don't allow suits as much as $7000.
Winning the lawsuit is the easy part. Collecting is the trick. And remember, once you have been awarded the judgment you can collect for a very long time....with interest! Eventually he will get a job or you will discover his bank.

Seriously though, the final enforcer is the court. The note you had the debtor sign (you do have this don't you) is what the court will base your claim on. If you judge agrees with your claim, you get a judgment. Which still doesn't get you your money but you have more power. If he has a job, you can garnishee his wages, if he has a bank account you can garnish that.
Collection is expensive and costly. See if you can't work out some compromise. Maybe reschedule the payments or accept a discounted payoff.
Short of that you might want to get an attorney who specializes in collections. He may take the case on consignment, but it may cost you 50%

The best you can do is write it off on your taxes (up to 3k each year). It's unlikely you will see the money again; chalk it up to life experience, many have lost much more! You might win a judgment, but how do you collect? You will have to "domesticate" the judgment to his current state, and since you don't live there how do you show up in court? And that only gets you a piece of paper saying he owes you....doesn't mean you can collect it. Even if you found out where he works or his bank, you would have to file a "writ of garnishment" to garnish his wages. So as you can see it's not as easy as it seems.

Small Claims Court!!! Go on a television show and they will even pay you to appear, award your money (if you win) and make him reinburst you for legal fees (monwy for filing)

Dude, if you get it please do let me know, someone owes me 30K plus and I can't do a **** about it. I see him everyday and all he does is look somewhere else and walk and pretends he does not know me.
