No. It's partially their fault for leaving their wireless router unsecured. That means yours is unsecured too. You should set up WEP so people can't connect to yours. In your wireless card's profiles, you should set it up to only connect to your routers SSID instead of best available.

What a bunch of useless answers, many of which are so wrong it's not funny.
Tresspass on another wirless network even if there was no intention or hack can be against the law based on where you live. Certain states and countries have passed very strict laws on this however to date there has not been a case where use of an unsecured wireless network for Internet access has actually gone to trial. In the US a good lawyer could bring up all sorts of interception of wireless radio signal rules not to mention "intent" would be key here.
Check the laws in your state or country.

They can't really know unless they have a detector.. one of my hacker protectors can automatically detect and let me know whose IP address is using my wireless connection.. and asks me what to do... You should go into your settings and change it from automatic to manual.. that way it will not connect unless you do it yourself..
also.. like others have mentioned.. put a WEP key [a password] on yours so they can't take advantage of you.. you should be able to do that by typing in 168.192.1.1 in the address bar... try to find a menu.. and then follow the instructions.. make it a random mix of numbers and letter [write it down!!!] then go back into your settings change YOUR connection to automatic [so you don't have to put it in every time you log on] put the key in and go

I'm not sure about Australian laws but i think you can get fined for privacy reasons but in Singapore, i heard that there was a man who just tapped into someone else's wireless network without permission and got jailed for 2 years. But i don't think Australian laws won't be that strict. Anyway, there should be a way to not let your computer connect to your neighbours network or you can ask your neighbour to but on WEP or WPA security so you can't access it without a password.

LOL no you have nothing to worry about. This is not illegal. I go on my neighbors internet all the time with my laptop. They might finally figure out that someone is using their internet and the most they can do is set it up with a password so you cant get on unless you have the password...but you cant get arrested!!! but he may go to eithernet cable, and take his antenna off the router, to rob you of any more of his signel
