On Dec 10th, the police demanded entry to see if the tip they received about my son's safety, we were guilty partly , the cats were taken by Animal services. The only issues was the urine odor, and the fridge, the rest of the house was clean, food in the house, but due to my prior dealings with CPS, and the cops attitude towards us, prompt the worker to take our son, I think she was expecting something worse, by the way she acted. I think the cops intimidated her into taking him. This time though, I'm not going to let them get away with this. I've learned a lot of things, I'm not stupid anymore. Their threats won't intimidate me. Their in for a treat, then maybe I'll get some respect, for finally having the balls to stand up to them

Sorry to hear about that. I would think they would do an additional inspection. I would recommend checking on what can be done for your Fridge and Smells. I know more about the smell issues and If you want to cover the smell, then you can use a product called Alanite (*they are special lava type rocks), this absorbs the smells and then you can set it outside later (in the sun) and the smells are released outside. or you can get an Air cleaner that will remove the smells. I hate to tell you, but the urine odor was probably enough, even if the fridge was completely clean. Prior dealings with CPS probably made this the icing on top of the cake for them.

As laws very by state it is hard to say if they had probable cause in your case. However, they most likely did, since you had prior dealings with them then you should have known that there would have been a chance that you could lose your children for not having a clean home, and yes cat urine is considered to make your home deplorable. you should contact a lawyer.

I had been charged with child abuse and it was found not true..then I moved to another city..someone turned me in for giving my child ritalin for ADHD..the social worker didn't agree that he should be on it and found me guilty of child neglect...it was later overturned in court...she did not offer to get his medical reports and see that he needed it or check his school reports..she just decided that her beliefs were right and because I had been investigated in the past that made me guilty..I asked my lawyer if I could sue her and he told me that they have the right to make their own decisions even if they are wrong and there's nothing we can do..which is wrong...but I would be fighting a state system and I can't win. Therefore I lost my right to ever teach or work with kids again.. GL if you decide to fight them but it may be a losing battle.

And yes, those are adequate grounds I'm afraid, but do not let that detour you in attempting to take back your children. However, if you succeed in reclaiming them, be careful to maintain a hygenic atmosphere for them as they lack the immunities adults have developed and are therefore more susceptible to various diseases and disorders.

Unfortunately having had prior dealing with cps isnt going to help your case at all.
