no stores should be able to refuse a non-white male to be santa.

Pretty soon they wont be allowed to have a Santa at all regardless of skin color. There's going to be some group of people that will complain about it not being fair to those that don't believe in Christmas. I cant believe it isn't already been a huge ordeal. Either that or you'll see kids getting their picture taken with giant dradles (spelling). I think by law they have to give all colors a chance to apply and interview, but they can always just say the white guy was better then the black one and that's why we chose them. I mean is one Santa really going to have a better resume then another?

Hmmm, that is a great question. You see race discrimination in hiring cant be proven on just one occassion. You really need to show a pattern of discrimination. If no "non-white" santas are hired then you would definitely have a pattern. Santa though is an iconic image - the fat bastard is white bro! So, somebody hiring a Santa could say that its not a "pattern" of discrimination, its an icon! So your best bet then is to show that the pattern of hiring is not indicative of the percentage of "races" in the area. But now its not about hiring "non-white" santas its about whether the company who hired the Santa has "non-whites" who work for them in other areas. Tough call, if the white Santa company hires "non-white" people to work for it - you can't really say they are discriminating. So now the only thing you have left isn't a legal argument but rather a sympathy call - "but there are "non-white" Santas out there - why can't I be one? Well, Santa = marketing, and marketing is business startegy and that's up to the bosses - as long as they don't discriminate. Good good question. If I was a lawyer, I would take your case.
