No, you can not.
One in 100 women who take the pill get pregnant while on it every year. It states so in the packaging.
Secondly, its only 92% effective by use. Not 99%. In order for it to be 99% effective you have to be on the proper doctor monitored dosage, be taking it EVERY SINGLE DAY WITHOUT SKIPPING A SINGLE DAY, and take it at the EXACT same time every single day. The exact hour every day, for atleast three months, before its effective. And then you have to continue to do so for the duration of the time you take the pill in order for it to function as well as its going to. And you have to be monitored atleast every 3-9 months to make sure your cycle is still conforming to the pill. Any break through bleeding or such symptoms need to be reported to your doctor, because this generally means the dosage is wrong.
Ive never heard of anything so stupid in all my life. Suing for making babies. Jeez.

Most people are saying no, but I say give it a shot. If an old lady can spill mcdonald's coffee in her own lap and sue an win, I think you might have an outside chance of winning. You need to do two things: 1) find a shark of a lawyer who has the soul of a pitbull 2) make sure this lawyer draws a real dumb jury, such as the oj jury or the afforementioned mcdonald's jury. Judging by last month's elections, your lawyer should have no problem gathering 12 idiots together for your trial. Happy Sueing!

I considered the same idea when I got pregnant, I was using the birth control pill.
I found out medications can "cancel out" others so to speak. This is why you need to let your doctor know of all the medications/drugs you are taking.
I was on another medication which "cancelled out" the birth control I was taking. Insane thing about it my doctor (past doctor) was fully aware of all the medications I was on, he was the only who prescribed my medication.
After my little baby was born, there was no way I was going to sue a doctor for my blessing, obviously my baby was meant to be born for a reason.

No. There is no single method of birth control that claims to be 100% effective. In addition, you would have to prove that you had taken or used the birth control exactly as directed, which would be impossible.

No you can't. People get pregnant ALL the time while on birth control. If you will read the materials that you receive when you buy the pills, it says that it is not 100% effective. There are no promises, so use it at your own risk.

no you can't sue because even with birth control there is still like a .02 % chance that you could get pregnant, you took that chance when you got on it.... man these days every one wants to sue some one else...what is wrong with the world?

No. That is why they say they are only 97% effective. You would fall into the 3%.
