The person must be questioned first for the reason of the crime if he gives some answer then its okay. Because no man is born criminal as the society makes them what they except for some currupt mind and devils

Sounds like an opinion piece. You could do retribution: what's done to you, is done to them. Or they could pay for it with money, or just the plain old death penalty. Of course, if your too strict in our laws, it causes a feeling of scared in society. THen again, if its too easy, those with more money can boss around the less fortunates. So this question sounds like what you believe what should happen to people who do crimes.

probation or sentenced to jail .. hmm.. 5? 10 years imprisonment depending on the crime done.

(1) Hold them responsible for the consequences of their actions, including restitution to the victims of crime, and repayment of public costs for investigation, trial and imprisonment.
(2) Require parties with knowledge of crime or criminal behavior or addictions to come forward with information in order to qualify for plea bargained sentences, mandatory rehabilitation and community service as restitution.
(3) Otherwise, obstructing or evading justice should be punished by losing one's citizenship and serving the equivalent time in a foreign prison by inmate exchange with other countries. For violent crimes involving murder or rape, if convicts served either mandatory or voluntary restitution by replacing children or women working in slave labor factories to feed their families, they could help save other lives in place of the lives they destroyed that can never be replaced.
(4) Those with pedophile or homicidal criminal addictions should be detained in isolation from the regular population, for both the safety of the public and their own safe rehabilitation where possible. I propose building a prison complex across the Mexican border to house violent criminals and sex offenders, so that in exchange for each person who loses citizenship, as punishment for violating the rights and freedoms of others, an opening is created for applicants seeking legal citizenship in the U.S. to become productive law-abiding contributors to society. So this dual system would deter crime by punishing criminal behavior while enforcing respect for the laws as the requirement for citizenship.

Again, in order to qualify for local sentencing and community service and rehabilitation, those who have committed crimes, and/or their friends and families with knowledge, would have to come forward and report the person and confess fully; while those who hide their crimes or evade the law would be punished more severely by losing their citizenship for their length of their sentences, including life. I think enforcing consistent consequences for both lawful and unlawful behavior would serve as a stronger deterrent to crime that would correct, prevent and reduce crime and violence both in this country and worldwide.
