It is a right ... kids need a break from their studying and work and learning in order for it to register in their brains. Just like we need a break from our job so we can work more productive.

A break for a drink, going to the bathroom, and a few minutes to rest the brain - that is a right. Time to play games or visit with friends - that is a privilege. I don't believe there are any laws requiring recess, though it could be different in some states. Different school districts would also have their own regulations/rules on this. Most district's recess times are dictated by the teacher's contract for break times. - 6th grade teacher, California
