you need to get an attorney that knows the answers to these questions before going any further

You have not provided enough information to get a complete answer to these questions. The determination of what court to file the suit in depends on several factors: How much is the claim worth? If the claim does not exceed a specific amount, Frank may be able to pursue his claim in small claims court for very little cost. Are Frank and the Company in different states? If his claim is very large (more than $75,000), Frank may be able to file suit in federal court, but this may not be his best option. I strongly recommend that Frank consult an attorney first, as sometimes an attorney's involvement is enough to get the company to respond without filing a lawsuit. The attorney can also help to evaluate the strength of Frank's case, based on the actual problem, Frank's actions, the warranty, if any, contractual elements, etc.

Unless Frank's case has the potential to make a sizable fortune for the law firm, he will not get any representation so the question is academic.

If this question was posed for the US, there is no such thing as equality in the eyes of the law anymore. You either buy the law or the judgement you want or you lose.

Well Frank, the first step is to get a lawyer. Then let him do his
job. Make sure you get one that doesn't get paid unless you win.

MERRY CHRISTMAS and have a nice day.

Thank you very much, while you're up!!!
