no, the president enjoys the presidential power of war acts, he can declare war against anyone at any time, this is supposedly only in emergency's only and then congress can decide later as to if the president was right , Roosevelt pulled this when he declared war on Germany,our congress had tentatively agreed to go to war with Germany against Russia,the U,S, didn't want to fight against our mother country England, A peace agreement was being worked out with Prime minister of England , and the prime minister of Germany , but, the English kicked out the P,M, and installed Churchill unknowingly the P,M, of Germany landed in England , they arrested him , he spent over 50 years in spanda prison before he died, Mean while
roosevelt declared war on Germany under false pretense,

But since then, the President can do this "90-day" thing, and some wars are called other things like 'police actions'.... standard loopholes to get around being regulated by laws...
