Okay (i hope you have a minute)...

My best friends wife up and left one day and told him it would be best if he moved away to another town to make it easier on both of them. She told him to cash in his 401K and sign the papers to refinance the house so that she could use the money from both items to pay off all their bills and pay off her car and his Harley (which she had in her name).

Now the problem is - she gave him none of the money from the refinancing or the 401K. He moved to another town and the divorce papers were sent to him with a note from her saying all he had to do was sign because their was nothing to contest and no custody issues. He signed the papers and now she is holding the title to his bike unless he gives her $500.00 a month towards the mortage on the house (which is only $800.00 a month). By the way - she lives in the house with her boyfriend.

WHAT CAN HE DO? She sent him a letter saying that she was going to reposes the bike from him unless he pays!

Just so you all know (because I forgot to tell before) she took EVERYTHING in the divorce - all he wanted was the bike.

It's going to cost more in attorney's fees than it will to buy a new bike. He has no obligation to pay anything toward the mortgage unless the deed is in his name. But if she owns the title to the bike she has the right to let him "buy" the bike back from him.

She sounds pretty vindictive to me. I would walk away and buy my own bike just to be done with her.

Tell him to get an attorney.
If he wants to keep the bike that is.

Oh' yah. And tell him to make better choices next time pertaining to women. If all he loses is the Harley, then hes getting off lite.

Maybe he can get another bike. But he should record her message or get her to write it on paper. If she calls, he is able to record the conversation as long as he is involved in the conversation.

Stoopid is as stoopid does. This guy has to be brain fried. He needs a lawyer, and quick. Sounds to me that he has nothing left to salvage except a dumb bike and what remaining self esteema nd pride he may have. tsk tsk tsk, lesson learned, i hope.

first off, he's an idiot for signing anything without talking to a lawyer. I'd say he's pretty much screwed. Have him see an attorney at once to see if he can salvage anything.
