no that doesn't make you a racist. your situation is basically "your damned if you do and damned if you don't." You see not that long ago in this country a lot of people of color that was qualified to work for many companies was denied work because of their race. that basically made it difficult on companies that weren't biased because now you have to make a significant sacrifice to abide by the law (which is now a result of the above explanation)
and if you are using government funded money, you have to come up with a plan to follow the law, remember you are running a business and it is your livelihood. on the point of it being unfair it is but it's just one of those issues we all in this country has to deal with so don't get all depressed about it, get up, dust yourself off and get to planning your next move.
P.S this may cost more money but, try to come up with a training program or create more positions at your company. just a thought....

You are stepping into the unfair world of reverse discrimination, also known as affirmative action.
It is a well meaning strategy to make sure that black people are not discriminated against. However, it should be fair in the sense that the better candidate/experience/education/test score/whatever - should earn the job. Nothing else should matter. For some people that will be a hard thing to do. Even if they are not "racist", some people may feel more comfortable hiring someone of their own race/nationality. And that, my friend is not fair either.

Hiring the guy who is most qualified is not racist it is good business.The government has no business telling people who they have to hire. If your company goes under because you hired unqualified people to meet some race quota is the government going to reimburse you the money you lost.

Most unfortunately- yes. Everyone should be judged on their capabilities. But that is also why the law was in place to start with. A black man who was overqualified would be dismissed without an interview, and some would rather train a white with no experiance. This now, is just the way it is, just like that is the way it was then.
