My sister has a problem with her ex-husband, he currently has physical custody of their two oldest children, they live in New Jersey and my sister lives in California. He has disappeared off the face of this earth with the children, and did not give my sister a phone number or an address where she can contact her children, what can she do? It has been a week now since he disconnected his phone number and about three weeks ago she sent her son a package and the package was returned today marked "attempted not known"...

Her actions would depend on their custody agreement. I would think that he would at least, have to let her know where they are. If she has visitation, then she would definitely have to know where they live. The best thing to do would be to contact a lawyer after looking at their custody agreement. Unless her parental rights were terminated for some reason, he has a responsibility to her. Of course, there might be a reason, maybe he lost where he was living and just has not had time to do a forwarding address. Does your sister pay child support? They would be able to track him down since they would have to have an address to send the check.

Depends! Does he have full or temp custody of the children? If he has temp he can not leave state in most cases. If its full yes he may have the right but in most cases to leave the state with full custody, he still needs the courts permission to move so far away. She needs to talk to a lawyer, they will be able to tell her everything she needs to know. Plus in any case both parents should be able to contact the other parent in case of 911....! This might even be considered kidnapping.....Then again it does also depend on why he has custody in the first place!

If they have joint custody or their parenting plan states that he has to keep her informed of address & phone number at all times then she can call the cops for parental kidnapping to begin a search for her children.
